TERMS AND CONDITIONS - TRUGYM HUDDERSFIELD.



  1. Contract Memberships

If joining on a 12 month contract agreement. 12 monthly payments must be made before cancelling this membership. After the initial 12 month period this will go to a rolling contract in which you can cancel with one month's notice.To cancel your membership you must give written notice. If you wish to cancel inside of this 12 month contract then you must do so with evidence for one of the following reasons: 


  • Redundancy / Loss of Job (P45, Letter from former employer, Universal credits) 

  • Moving house (more than 10 miles away from club, from the address we have on the system) 

  • Medical (Show a note from a doctor or GP that you should not train) 


When providing proof you will have to pay an admin fee of 20% of your remaining balance. 


Once you have made your 12 payments of your contract, it will automatically convert into a rolling monthly plan. For cancellations, we require a minimum of 30 days notice, in which you will be required to make any full payments that fall within this period. You will have access until the end of that calendar month. To cancel your membership you must give written notice. 


You may freeze your membership at any time for up to 6 months.


The payments which are frozen are then added onto the end of the membership so 12 payments are still to be made. After 6 months, at least one monthly payment must be paid before going back on freeze again. The freeze must be requested at least 5 days before the payment is meant to come out. You may freeze your membership for longer under certain circumstances such as pregnancy. 



12 month contracts can be upgraded at any time throughout the 12 months. However, downgrades must be made outside the 12 month minimum period. 


Failure to make payments at the correct time will result in an automated email to yourself 4 days after the payment was due asking for this payment. Failure to make this payment 1 week after the due date results in a second email asking to pay the payment and notifying you that a £25 charge will be added. 14 days after the due date another email will be automatically sent out explaining that a £50 charge is now on the account due to failed payments. Finally if this payment is still not paid, 21 days after the due date a £75 charge will be added to the account. Whilst in debt members won’t be allowed use of any of the facilities. We have the right to waive these fees should we wish depending on members' circumstances. 


All payment schedules to be sent via email when membership is started with terms and conditions attached with this. Once your 12 month contract is up your membership will then go to rolling. 


  1. Non Contract memberships

If joining on a non contract membership agreement. You must make one full payment before cancelling. Your membership will either go out when you first sign up (eg 20th May) or you will pay a pro-rata from the day you sign up and a full payment on the first of the following month.For cancellations after these two months, we require a minimum of 30 days notice, in which you will be required to make any full payments that fall within this period. You will have access until the end of that calendar month. To cancel your membership you must give written notice. 


If you wish to cancel without a final payment we can do so for the following reasons.


  • Redundancy / Loss of Job (P45, Letter from former employer, Universal credits) 

  • Moving house (more than 10 miles away from club) 

  • Medical (Show a note from a doctor or GP that you should not train) 


All must be proven by an official document. (eg, council tax, water bill, tenancy agreement, bank statement)

All cancellations must be done via email and you must give 1 months notice. 


Overdue Memberships


If your membership is overdue, your membership cannot be cancelled or be frozen, All outstanding balances must be cleared before your membership is cancelled or frozen. 


Subscription Cancelled


Any emails which you receive stating ‘subscription cancelled’ is not cancellation of the membership, this is cancellation of the DD from your side. Your membership will remain active until an email is sent. 


Student Memberships


  • Anyone over the age of 16 can legally sign in to a gym membership, whether this be contracted or no contract. Therefore the same cancellation rules apply. 


Prepay Memberships 

  • Any pre-paid memberships which are frozen, the months will be added on at the end of the membership. 

  • The initial prepay sign up price will be honoured when renewal is activated. 


  1. Membership Offer Sign Ups


Please note if you sign up to any black friday offer or membership offer you will not be able to cancel until you have made a full standard membership payment, as offers will be discounted during this period. You will always be required to make one full payment at the normal price. 



  1. Age Limits

Children over the age of 12 can use the gym facilities, but must be supervised by someone over the age of 18. Children under 16 can use the pool if accompanied by an adult, between the allotted times. Anyone under the age of 16 needs to have a children's membership, or family plan. Anyone 16 or older must have an adult membership. Anyone who does not follow these rules will lose their membership with immediate effect. 


Whilst on poolside members under 16 cannot use any of the spa facilities only pool and can only access the pool within certain times as listed below: 


Monday - Friday

2pm - 5pm 


Saturday and Sunday 

9am - 12pm and 2pm - 5pm 


 We do have swimming lessons externally booked outside these times. 


  1. Induction / Waiver form

All members must either sign an induction waiver form available on the club website prior to using the gym facilities or complete an induction with a member of our staff to show them how to safely use these facilities. Anything advanced will need to be booked with one of the club's personal trainers. If is down to you to sign the induction waiver form.

Please Note, Any injuries which occur on the gym floor will be at your own risk and the gym will not take any responsibility for this. 

Please make sure all pins are attached in the machine correctly, all weights are places on to machines correctly and safely. Also making sure when putting weights away they are put on the weight tree correctly. 


  1. Health Conditions

Any health conditions that may affect training must be made known to staff prior to using any of the facilities. If at any point new health concerns arise that were previously unknown, members must let staff know as soon as possible and before training again. All members must sign an induction waiver form or complete a full induction prior to using the facilities which are available to book via the app. All members must also complete the health questionnaire prior to using the facilities which will be emailed to them along with the terms and conditions and a breakdown of payments. Members participating in classes who have existing health conditions do so at their own risk. If any injuries were to occur whilst participating, then the member waivers all responsibility from the instructor to themselves.


  1. Member Conduct

Members must follow the club rules and terms and conditions at all times. Failure to do so can result in immediate termination of membership. 


Members must respect the equipment and must use the facilities as shown by a member of the truGym staff. Any damage to equipment due to misuse or intentional damage will hold the member liable.


Members must act courteous in their manner and be respectful at all times to all who visit the gym. Must not cause disturbance to other people. 


Memberships can be terminated at any time by truGym Huddersfield for breaking any of the rules provided and reserve the right to keep partial payment made to cover the cost of damages. Appeals against termination must be sent to the manager of the club to decide. 


  1. Locker Keys 

Please note, if you do lose your locker key you will have to pay for a replacement.  All replacement Locker keys are £6. 


  1. Padlocks 

Please note all padlocks are £5. Padlocks cannot be stored overnight and will be removed if kept in the club overnight. You will then have to bring or purchase another one. 


  1. Class Booking

All classes are booked via the clubright app, which is also where you shall find your QR Code which is your access to the club. Cards will be available to those who need them and members are able to book classes with reception if needed. Classes open for booking one week prior to class date at 6am each morning. 



  1.  HOURS OF OPENING

  • Information in relation to the Centre's normal hours of operation and the manned hours of the facilities are available from the Centre upon request. Such hours may be lengthened or shortened at the absolute discretion of the Centre with or without any prior notice being given to members. The Centre shall endeavour to give members reasonable notice of change to such hours.

  • On occasions when necessary, maintenance is required, the Centre, or parts thereof, may be closed. Any refund given as a result of closure will only be made at the sole discretion of the owners.


  1. Multi-club access

Members will have access to other clubs in the truGym family. Please ask their reception to call our club for confirmation or provide proof showing your clubright app. 


  1. Payments


We reserve the right to amend payments at any stage in your membership. This could be by setting up a new membership or cancelling your current one to increase to a new package. 


  1. Footwear


The correct footwear must be worn at all times. No sliders/Crocs. 


  1. Injuries


Please note, If any injury occurs whilst on the premises, the fault will be yours & your responsibility to report your injury to receive suitable first aid. 


  1. Other 

Refunds will not be given to members should part of the facilities close for any reason outside of our control. If we take away partial use of facilities we will try to get this back up and running as soon as possible, done safely. 


Smoking and vaping is prohibited in all parts of the facility. 


Swimming pool temperature can legally be at - 26-28 degrees. 


  1. LIMITATION OF LIABILITY

3.1 The member acknowledges that the gym/s  obligations and liabilities in respect of the Centre are defined in this agreement and/ or within the Regulations Applicable to All Users.

3.2 The member is responsible for the consequences of any use of any of the facilities of the Centre. The Centre will not be liable for any indirect or consequential loss, damage, costs, expenses, theft or damage to property, whether arising under contract, or otherwise.

3.3 Lost Property will be held for one month and disposed of if not collected during that time. The Centre does not accept any liability for items left or discarded by members.


  1.  PHYSICAL HEALTH OF MEMBER

4.1 The member warrants and also represents that he/she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, well-being or physical condition, the member acknowledges and has read and agrees with the Health Commitment Statement displayed at Reception and available on the website. The member acknowledges that they understand that they are responsible for their own well-being and safety during the unmanned hours and in the event of an emergency they will use the emergency help phone numbers to contact the out of hours manned call centre.

4.2 An induction is available free as part of the membership for all new members, the member has the choice to opt out of the induction at their own risk. In the event the member does not organise and attend an induction with the club, this will be deemed to be their confirmation that they have opted out of having an induction and are fully confident about using the equipment safely and as the manufacturer designed the equipment for. In the event that a member opts out of an induction, including failure to arrange and or attend an induction,  they agree that they have read and agreed the following Induction Waiver:

Induction Waiver: It is formally noted that you have opted out of induction training and will undertake to consult staff on an ongoing basis in manned hours in relation to the safe use of our facilities and equipment and that you accept responsibility for your own wellbeing during unmanned hours. This Club recognises the importance of every new member undergoing our induction training. This is carefully designed to ensure that the individual is made aware of the facilities and equipment on offer and in particular is given advice in the safe use of our facilities and equipment. We strongly recommend each new member to undergo our induction training. It is hereby noted that notwithstanding our clear advice, you are a confident and experienced gym user and have made an informed decision not to undertake induction training. In these circumstances the Club will allow you to use the facilities, provided that you seek advice from a member of staff if you are in any way unfamiliar with a particular piece of equipment or type of exercise.

  1.  FIRE EVACUATIONS

If you discover a fire, operate the nearest fire alarm. If you hear the fire alarm: 

  • Leave the building by the nearest exit. 

  • Do not stop or return to collect personal belongings. 

  • Go to the assembly point (usually the car park) and remain there. 

  • Return to the building only when authorised to do so by the Club Manager.


  1.  THIRD PARTY RIGHTS

A person who is not a party to these Terms and Conditions shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce or rely upon any provision of them. 

21. USE OF PERSONAL INFORMATION

We use the personal and transactional information (e.g. name, address, email address, phone number) ("Personal Information") you supply to us in order to fulfil your order. The lawful basis for this data processing while your membership is active is Contract. The lawful basis for the processing if your membership is cancelled or lapses is Legitimate Business Interest. 

22.  UNAUTHORISED ACCESS TO PERSONAL INFORMATION

Unless a member of our staff has been fraudulent or negligent, we will not be liable to you for any losses you may suffer as a result of unauthorised access by a third party to the information (including in particular credit/debit card details) you transmit when you place an order. It is your responsibility to ensure the security of your own credit/debit card details to avoid unauthorised use.

We reserve the right to amend the terms and conditions at any point without notice.
